The Daily Halacha Moment - In Doubt If Recited Birchot HaTorah

“Anyone who studies Halachot every day is guaranteed that he is destined for the world-to-come” (Megilla 28b, Niddah 73a)
Question:
What should one do if one is in doubt if he recited Birchot HaTorah?
Answer:
If someone is unsure whether they have already recited Birchot HaTorah, they should preferably hear someone else recite the blessings. The listener should have the intention to fulfill their obligation by listening, while the speaker should intend to fulfill both their own and the listener's obligation. If this is not possible, one should have the intention to fulfill the obligation through the bracha of Ahavah Rabba or Ahavat Olam and engage in Torah study immediately after davening. If that is not possible, Ashkenazim may recite the beracha of Asher Bachar Banu.[1] However, Sephardim, if unable to hear the beracha from someone else or fulfill their obligation through the beracha of Ahavat Olam, should not recite the blessings because it is a safek brachot lehakel since it is a dispute in the rishonim whether Birchot HaTorah are Deoritta (Ramban) or Derabanan (Rambam). [2]

Orchot Maran (5:6) mentions that when Rav Ovadia Yosef was uncertain if he had recited Birchot HaTorah, he asked Rav Dovid Yosef to recite it for him. Ashkenazim, however, may recite the bracha of Asher Bachar Banu, as the Mishnah Berurah (47:1) cites in the name of the Shagat Aryeh.
